These terms govern access to AvisaFlow, subscriptions, customer data, and the official WhatsApp automation features.

By creating an account, purchasing a subscription, or using AvisaFlow, you agree to these Terms and the Privacy Notice. If you act for a business, you confirm that you have authority to bind it.
1. Eligibility and acceptance
You must be at least 18 years old and legally capable of entering a contract. You may use AvisaFlow only for lawful business activities and in compliance with the laws that apply to your business, customers, communications, and industry.
2. Accounts and authorized users
You are responsible for accurate account information, secure credentials, authorized team access, and activity under your workspace. Notify hola@avisaflow.com promptly if you suspect unauthorized access. You may not share credentials in a way that bypasses plan limits or access controls.
3. The service
AvisaFlow provides web-based tools for appointments, booking, customer records, staff, payments, reporting, documents, and communications. Features may vary by plan, country, industry, or third-party availability. Product descriptions do not guarantee a feature will remain unchanged forever.
4. Trial, subscriptions, and payments
Plan price, billing interval, trial terms, taxes, and included features are displayed at checkout. Stripe processes subscription payments. Unless cancelled, paid subscriptions renew automatically for the selected interval. A failed charge may lead to restricted or suspended access until payment is resolved.
Payments are non-refundable except where required by law or expressly approved in writing. Cancellation stops future renewal but normally does not create a prorated refund for the current billing period.
5. Meta and WhatsApp services
New WhatsApp connections use Meta Embedded Signup and the official WhatsApp Cloud API. You retain ownership and control of your business portfolio, WABA, number, templates, customer relationships, and Meta billing account. You authorize AvisaFlow to use the permissions and encrypted access credentials needed to provide the messaging features.
- You must maintain an eligible Meta business and WhatsApp Business Account.
- You must provide accurate business information and maintain any required payment method.
- You are responsible for Meta message charges, taxes, template approval, number quality, and policy compliance.
- You must obtain valid opt-in before messaging and honor every opt-out request.
- Business-initiated messages must use approved templates when Meta requires them.
- You must not place unnecessary sensitive information in messages or templates.
AvisaFlow cannot guarantee Meta verification, app review, template approval, number registration, message delivery, pricing, quality status, or uninterrupted third-party availability. Meta may suspend or limit accounts that violate its terms or policies.
6. Customer data and permissions
You control information entered about your clients and are responsible for having a valid legal basis to collect, store, and use it. You must provide required privacy notices, maintain accurate consent records, limit access to authorized staff, and respond to rights or deletion requests. AvisaFlow processes that information to provide the service under your instructions and applicable law.
7. Acceptable use
You must not use AvisaFlow to:
- Send spam, deceptive messages, harassment, or communications without required permission.
- Violate Meta, WhatsApp, Stripe, or other provider policies.
- Upload unlawful content or infringe privacy, intellectual property, or other rights.
- Process sensitive information without a valid basis and suitable safeguards.
- Probe, disrupt, reverse engineer, scrape, overload, or bypass service security.
- Resell, sublicense, or transfer the service without written authorization.
- Use the service for fraud, illegal goods, prohibited industries, or unlawful discrimination.
8. Your content and intellectual property
You retain ownership of content you provide. You grant AvisaFlow a limited, non-exclusive license to host, process, transmit, back up, and display it only as needed to provide, secure, and support the service. AvisaFlow and its licensors retain rights in the platform, software, branding, documentation, and related materials.
9. Third-party services
AvisaFlow depends on services such as Meta, WhatsApp, Stripe, Supabase, Vercel, and email providers. Your use of those services may be governed by separate terms. AvisaFlow is not responsible for third-party decisions, outages, policy changes, charges, enforcement, or data practices outside AvisaFlow's control.
10. Availability and changes
We aim to keep the service available but do not promise uninterrupted or error-free operation. We may maintain, update, add, limit, or discontinue features. When a material change affects a paid subscription, we will provide notice when reasonably possible or legally required.
11. Cancellation, suspension, and deletion
You may cancel renewal through the billing portal or support. We may suspend or terminate access for nonpayment, security risk, fraud, legal requirements, or material violation of these Terms. After termination, export access may be limited. Data deletion is handled according to our Data deletion instructions and legal retention duties.
12. Disclaimer of warranties
To the maximum extent permitted by law, AvisaFlow is provided as available and without warranties of merchantability, fitness for a particular purpose, non-infringement, or uninterrupted operation. Nothing in these Terms excludes warranties or rights that cannot legally be excluded.
13. Limitation of liability
To the maximum extent permitted by law, AvisaFlow is not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, loss of profit, revenue, opportunity, goodwill, or data arising from the service or third-party systems. Aggregate liability is limited to the amount paid to AvisaFlow during the three months before the event giving rise to the claim, except where law prohibits that limitation.
14. Indemnity
You agree to defend and indemnify AvisaFlow against claims, losses, penalties, and costs arising from your content, communications, customer data, unlawful conduct, violation of these Terms, or infringement of another person's rights, to the extent permitted by law.
15. Governing law and disputes
These Terms are governed by the laws of Mexico. The parties submit to the competent courts of Mexico City, Mexico, except where mandatory consumer or local law grants another forum. Before filing a claim, contact hola@avisaflow.com so the parties can attempt to resolve it.
16. Changes to these Terms
We may update these Terms to reflect changes in law, providers, pricing, security, or the service. Material changes will be communicated when required. Continued use after the effective date means you accept the updated Terms, except where affirmative consent is required.
